Terms of Service

Welcome to Stay Healthyr! These Terms of Service ("Terms") govern your use of the Stay Healthyr mobile application ("App") operated by us ("we," "our," or "us"). By using the App, you agree to these Terms.
1. Your Profile
Stay Healthyr does not require an email/password account. When you complete the setup questionnaire, the App automatically creates an anonymous profile ID on your device, which is used to store your fitness and nutrition data in our cloud database as described in our Privacy Policy. You're responsible for keeping your device secure, since anyone with access to it can access your profile.
2. Use of the App
Stay Healthyr is designed to help you:
- Receive personalized meal and workout plans based on your health information.
- Track your nutrition and fitness progress, including AI-assisted food photo recognition and barcode scanning.
- Use journaling tools for self-reflection.
- Participate in challenges like the 5K Challenge, Hiking, Bike, and Run/Walk modes, and optionally appear on the public leaderboard.
- Sync steps and activity data with Health Connect.
You agree to use the App only for lawful purposes and in accordance with these Terms.
3. Subscriptions & Payment
Stay Healthyr Pro is an auto-renewing subscription (monthly or yearly) purchased through Google Play and managed via RevenueCat. Payment is charged to your Google Play account at confirmation of purchase, and your subscription automatically renews unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription anytime in your Google Play account settings. Refunds are handled by Google according to its own refund policies — we are not able to issue refunds directly. If a free trial or promotional offer is provided, any unused portion is forfeited once you purchase a subscription, where applicable.
4. Service Interruptions
While we strive to maintain uninterrupted service, the App may occasionally experience downtime due to maintenance, technical issues, or circumstances beyond our control (including outages of third-party services we rely on, such as Firebase, Google Gemini, or Open Food Facts). During such interruptions, access to some or all features may be temporarily unavailable. Temporary service interruptions do not entitle you to a refund outside of Google's standard subscription refund policies. We will make reasonable efforts to notify users of planned maintenance but reserve the right to perform emergency maintenance without prior notice.
5. Health Disclaimer
The content and features in Stay Healthyr — including workout plans, nutrition estimates (including AI-generated ones), and health data synced from Health Connect — are for informational purposes only and do not constitute medical advice. Always consult a healthcare professional before beginning any new diet, workout plan, or health routine, especially if you have a pre-existing condition.
6. AI Food Recognition & Camera
When you photograph a meal, the image is sent to Google's Gemini AI service to estimate its nutritional content, and barcode scans are looked up against the free Open Food Facts database. These are automated estimates and may be inaccurate or incomplete — you're responsible for verifying nutrition information yourself, particularly if you have allergies, dietary restrictions, or medical conditions.
7. Location Services
The Run Challenge feature uses your device's location, including in the background while a session is active, to track distance, route, and pace. Your detailed route is processed and stored on your device; if you submit a result, only summary statistics (distance, time, pace, calories) are uploaded to the leaderboard, as described in our Privacy Policy.
8. Advertising
The App displays ads served by Google AdMob, including optional rewarded ads that unlock additional AI food-photo analyses. By using the App, you agree to the display of these ads. See our Privacy Policy for details on the data ad providers may collect.
9. User Content
You may create journal entries and track personal progress data in the App. If you participate in leaderboard challenges, the display name you choose is visible to other users. You retain ownership of your content, and can request deletion of cloud-stored data as described in our Privacy Policy.
10. Privacy
We take your privacy seriously. Please refer to our Privacy Policy for full details on what information the App collects, how it's used, and which third-party services (Firebase, Google Gemini, Open Food Facts, Google Maps, AdMob, RevenueCat) it relies on.
11. Data Management
Some data is stored only on your device; other data (like your nutrition and workout history) is stored in our cloud database, linked to your anonymous profile ID. Uninstalling the App removes everything stored locally, but cloud-stored data persists until you request its deletion. We reserve the right to suspend or terminate your access to the App if you violate these Terms or engage in unlawful or harmful activity, including submitting false results to the public leaderboard.
12. Modifications to the App
We may update or modify features of the App at any time to improve performance, add functionality, or address technical issues.
13. Limitation of Liability
We are not liable for any damages resulting from the use or inability to use the App, including but not limited to health outcomes, inaccurate AI-generated nutrition estimates, or data loss, except as required by law.
14. Disclaimer and Limitation of Liability
By using Stay Healthyr, you acknowledge that all recommendations, plans, and features provided by the App are intended for general informational purposes only. You are solely responsible for any actions taken based on the information provided in the App. We encourage you to independently verify any advice, plans, or suggestions, especially those related to health and fitness. We shall not be held liable for any consequences resulting from your reliance on the App. You also acknowledge and agree that we reserve the right to change or increase pricing for our services or features at any time, with or without prior notice, subject to Google's respective subscription policies. Your continued use of the App after such changes constitutes acceptance of the updated pricing. We assume no responsibility for any activity, decision, or consequence resulting from how you choose to use the App.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of your country or region.
